New York Workers’ Compensation Benefit Rates Increase

As of July 1, 2012 the maximum rate for injurys ocurring after that date with be $792.07 per week. This represents an increase over the prior benefit rate of $772.96 per week.

Following the 2007 reforms, maximum benefit rates are now pegged to the State Average Weekly Wage (“SAWW”) and are calculated at two-thirds of the SAWW.
