LOIS Obtains Re-Trial on Fraud

LOIS Partner Christian Sison, with Paralegals Taylor Rodriguez and Brianna Nicolas, achieved a successful outcome defending the rights of an agricultural product wholesaler. At trial in 2023, Sison prepared a layered argument on fraud, citing the Claimant’s work activity, her personal travel pursuits, and her failure to disclose prior injuries. The Law Judge disagreed, but Sison and Nicolas aggressively pursued its litigation position on appeal, requesting a reversal of the trial decision. In the interim, Sison and Rodriguez maintained regular contact with the employee’s attorney to push for a settlement with far lower exposure. The Board Panel ultimately ruled that a final decision on the fraud issue was premature. The Panel ruled that LOIS should be entitled to docket access for the employee’s prior accident claims. Sison can now pursue a closure via litigation or settlement, by virtue of declining to give up on their employer client’s rights. LOIS’s argument for multiple fraud counts pushed the Board to open the door for a new trial.
