• Employer: Window 2000, 2015 WL 1659055, [NYWorkCompBd Apr. 14, 2015]. Investigator's reports are not required to be submitted in order for video evidence to be admissible. Cited in subsequent cases up through 2018.
• Employer: Snl Aerospace Metals, 2017 WL 5633996, [NYWorkCompBd Nov. 10, 2017]. Occupational injury claim for the back, bilateral shoulders, and bilateral knees, was disallowed after the claimant and his experts could not meet the burden of proving causal relationship between job duties and injuries.
• Employer: Academy Express LLC, 2018 WL 5545593, [NYWorkCompBd Oct. 22, 2018]. The claimant required explicit permission to serve the carrier by electronic mail to its counsel, and as such, the claimant's service on the carrier was deemed defective. This affirmed a trial ruling that the claimant's unreported tips cannot be included in the calculation for average weekly wage.
• Employer: Lsg Sky Chefs, 2021 WL 3126830, [NYWorkCompBd July 15, 2021]. The appropriate mandatory penalty for the claimant's WCL § 114-a violation was a disqualification from any future wage replacement compensation benefits in this case for a period of almost 8 years, and the appropriate discretionary penalty was a permanent disqualification from any future wage replacement compensation benefits.
