A Civil Litigation Webinar

New York’s “Serious Injury” Threshold

In this video, “New York’s Serious Injury Threshold,” we provide an overview of Article 51 of the Insurance Law which provides that a plaintiff in a personal injury action arising out of negligence in the use or operation of a motor vehicle must establish that he/she has incurred a basic economic loss exceeding $50,000 or must establish that he/she has suffered “serious injury.” This video is from a live presentation on July 13, 2020.

We discuss the following:

  • What is the legal definition of “serious injury” in in New York?
  • What the “$50,000” carve out is and how it applies to reimbursement actions in New York.
  • What risk professionals need to know about motor vehicle recoveries in New York.
  • How recent case decisions will impact the practice in 2020.
