Construction Defense Team Associate Jonathan Mallozzi successfully argued to the Board Panel that the claimant was outside the scope of her employment and not subject to any special hazard when her accident occurred, and obtained a disallowance of the claim.

Earlier this year, the firm was retained on a claim where the claimant was adjudicated with a permanent total disability in 2016. The claim’s costs were escalating in dramatic fashion due to nine (9) different brand name medications being prescribed by a treating physician. This treating physician was previously successful in being deemed credible on the very same issue in 2018.

At the February 24, 2020 trial, Wetherington developed the record obtaining numerous concessions as to the claimant’s delay in bringing the claim and the lunch time policies set by the employer. However, the trial judge found the claim to be compensable and established the claim, inclusive of lost time awards.

LOIS attorney Nicholas Minerva recently won a decision favorable to his client, a national insurance carrier and their insured, in a case involving concealment of prior medical history shown at trial. The Court ruled that the claimant had committed fraud and as a result, all benefits issued were rescinded.
