LOIS Successfully Suspends Benefits by Invoking Medicals by Treating Surgeon

LOIS Associate Bradley Haymes and LOIS Paralegal Camille Taylor secured a suspension of benefits in a long-running New York Workers’ Compensation claim. The claim, established more than five years ago, had resulted in ongoing reduced earnings payments because of Carrier’s IME repeated finding of no MMI. Attorney Haymes never faltered as he obtained another IME that again found no MMI but this one recommended claimant to consult with her surgeon, and if no further surgery was needed, the claimant should be deemed at MMI.

Acting promptly on this IME recommendation, Attorney Haymes lost no time in obtaining the opinion of the surgeon, who confirmed that no additional surgery was necessary, the claimant had reached MMI, and that the IME doctor’s SLU assessment was accurate. Relying on this updated medical evidence, Attorney Haymes successfully secured a suspension of benefits, preventing any further indemnity payments. As a result, the claimant could not recover more benefits than the injury warranted.
