LOIS Obtains Suspension of Benefits Based on Claimant’s Non-Compliance With Board-Directed Deadline

LOIS Associate Elizabeth Pappas and LOIS Paralegal Emily Ostrowski successfully obtained suspension of benefits in a New York Workers’ Compensation claim. At a hearing not scheduled for labor market attachment testimony, Attorney Pappas successfully argued that compensation benefits should be suspended based on failure to submit evidence of work search per prior Board directive. Over the vehement exception by claimant’s counsel, who insisted that claimant should be permitted to testify, Attorney Pappas was able to demonstrate that claimant utterly failed to comply with the Board directive, and suspended benefits. As a result, the Law Judge issued a ruling suspending payments of indemnity benefits, which resulted in leverage in terms of settling the claim.
