LOIS Associate Chris Xyloportas and Paralegal Sarah Ramadas successfully secured maximum exposure reduction in a New York Workers’ Compensation claim. This claim involved a claimant on a treatment regimen including cyclobenzaprine, hydrocodone, zolpidem tartrate, and meloxicam.
In an effort to reduce an MSA, the attorney-paralegal team litigated the necessity of the Claimant’s medications. Relying on the Medical Treatment Guidelines and the Drug Formulary, Attorney Xyloportas obtained damaging concessions from the treating doctor that the zolpidem tartrate usage was unrelated to the claim, and that the usage of cyclobenzaprine was contrary to the Medical Treatment Guidelines. During oral arguments, Attorney Xyloportas meticulously detailed the issues with the claimant’s treatment and highlighted the concessions from the treating doctor. As a result of this ferocious advocacy, the team was successful in obtaining a direction to have the claimant weaned off of zolpidem tartrate and cyclobenzaprine.
