LOIS Defends Against Additional Sites, Reducing Exposure

LOIS Associate Elias M. Aydin secured disallowance in a New York Workers’ Compensation claim of an additional site raised 16 months after the alleged date of loss after proving no causal relationship. The claim had been initially established for the low back, and the Claimant raised the right leg as an additional site implicated from the date of loss. Aydin’s argument focused on the Claimant’s extensive lack of treatment in conjunction with the doctor’s concession that the right knee pain is radicular back pain rather than an actual injury. Ultimately, the Law Judge agreed with Aydin’s arguments as there was insufficient evidence to support amendment of the claim to include the right knee, and thus, the site was disallowed. By defending against establishment of the additional site, Aydin was able to reduce medical costs and overall exposure.
